Early on 9 April 2016, the fishing vessel Louisa foundered, with the loss of three lives, while anchored close to the shore in Mingulay Bay in the Outer Hebrides.

The skipper and crew, who had been working long hours before anchoring late the previous evening, had woken suddenly as the vessel was sinking rapidly by the bow. They were able to escape to the aft deck, activate the emergency position indicating radio beacon (EPIRB), and to don lifejackets. However, they were unable to inflate the liferaft as they abandoned the vessel.

Lack of surveyors at UK MCA highlighted as a programme of modernisation gets underway

The UK’s Maritime & Coastguard Agency (MCA) is modernising the way the UK Ship Register operates with a number of new initiatives being rolled out as the Agency is also addressing the issue of a shortfall in surveyors on its books.

At the All-Party Parliamentary Group for Maritime and Ports, attendees were informed that the MCA is considering increasing the fee structure for the UK Ship Register to above 2016 levels.

The registry is working to improve the response time for enquiries to one working day, while for complex issues it will take three working days. Increasing ship registry fees would match the higher levels of service being offered, the MCA said. The Maritime and Coastguard Agency has launched a consultation on its fees

The Maritime and Coastguard Agency (MCA) is required to comply with the guidance set out in HM Treasury’s publication Managing Public Money when recovering the full cost of the fee-funded services it provides in its role as a regulator which covers direct and indirect costs associated with delivering services to the public. The full cost recovery norm to fees ensures Government neither profits at the expense of consumers nor makes a loss for taxpayers to subsidise.

Since September 2006, the MCA has not changed its fee level and has consequently absorbed increases in ship registrations, ship surveys and merchant navy training costs. As a result, the industry has paid below-cost fees so the services which the industry has received have been publicly subsidised. There has been a shortfall between income and costs for the services provided in each year since 2010-11 (and likely since 2006). The shortfall for 2010-11 (the base year) is estimated at £3.7m (in 2010 prices). MCA efficiency improvements have helped maintain standards while keeping costs down.

MCA issues MGN 432: Safety during transferring persons

The UK MCA has issued Marine Guidance Note 432 in order to provide advice for all vessels engaged in transfers of persons at anchor or underway. It gives guidance on taking the necessary precautions, the use of trained persons and carriage of requisite equipment to aid a safe transfer and rapid recovery of a casualty from the water.

Pilots and Pilotage Authorities regularly undertake transfer of persons between vessels at sea, and it is recommended that this guidance should be read in conjunction with SOLAS Ch V, Regulation 23. However this guidance is predominantly aimed at those who are not experienced in such

UK MCA to launch a new digital vessel registration system

The UK Maritime and Coastguard Agency (MCA) has chosen Oceans HQ to provide a new digital vessel registration system. This is a major part of the MCA’s 2016-2017 business plan and should improve the way the flag administration provides a range of services.

Oceans HQ’s Vessel HQ software is already in operation with a number of other flag states. It is a software platform that maritime administrations use for managing the registry of ships and meeting their international obligations to the IMO. Oceans HQ partnered with Thoughtbot London to deliver the modern software solution to the MCA.

Western Med training event proves popular and successful

A large and enthusiastic group of 20 plus IIMS member surveyors and non members arrived on the island of Mallorca for a two day training event in Palma on 28 and 29 April organised by the Western Mediterranean Small Craft Working Group under the leadership of John Walker. The event was once more timed to coincide with the rapidly growing and increasingly important Palma Superyacht Show.

UK MCA issues Marine Guidance Notes MGN 547 and MGN 552

The UK Maritime & Coastguard Agency (MCA) has issued two new marine guidance notices in recent days.

MGN 547: Solid bulk cargoes – safe carriage of bauxite.
The purpose of this Marine Guidance Note is to advise the industry of the circular issued by the International Maritime Organization (IMO) Sub-Committee on Carriage of Cargoes and Containers, CCC.1/Circ.2, on safe carriage of bauxite and raise awareness of the possible dangers of liquefaction associated with carriage of bauxite.

Consultation period on proposals to change the Maritime & Coastguard Agency survey and inspection is open

The background to this consultation is that some years ago the Maritime & Coastguard Agency (MCA) began to experience difficulties in recruiting and retaining surveyors in a highly competitive market place. This trend has accelerated recently and has now reached the point where the MCA is no longer able to fulfil all of its statutory functions and obligations. Following completion of a review, which started in 2011, changes have been recommended, resulting in the suggested new operating model upon which they are now consulting.

In order to focus on the modernisation of the MCA survey and inspection functions in a way that most effectively supports their customers, the MCA welcomes contributions to the consultation process, which will run until midday on Thursday 21 April 2016.

MCA makes important changes to the Passenger Vessel Certificate

The Maritime and Coastguard Agency (MCA) is changing the way a Passenger Vessel certificate is issued. These have, up until now, been a combined Passenger Certificate (PC) and Domestic Safety Management Certificate (DSMC) which have been valid for five years with annual endorsements.

The MCA is now splitting the one certificate into two certificates; a PC and a DSMC. The PC will only be valid for one year whilst the DSMC will be valid for five years, but will need an interim audit on the 2nd or 3rd anniversary that the certificate was issued. The MCA has stated that this audit would take place during the running trials to minimise costs. A full crew will be required and drills will need to be performed to the satisfaction of the MCA. As well as this, owners will now be required to submit to the MCA an annual self-assessment against their Safety Management System (SMS).

UK MCA has issued a Marine Guidance Note to introduce the new Hovercraft Code which has been developed for Light and Small hovercraft operating in the United Kingdom or United Kingdom Waters (both at sea and on inland waterways).

Currently all hovercraft used for reward must be built to the requirements of the High Speed Craft (HSC) Code. The Hovercraft Code introduces a voluntary set of standards appropriate for small commercial hovercraft, which are equivalent to the HSC requirements.

Where a hovercraft is surveyed and certificated under, and continues to comply with, this Code, it is exempted from those parts of the Hovercraft (General) Order 1972 and the Merchant Shipping (High Speed Craft) Regulations 2004 which require the hovercraft to be surveyed and certificated against the British Hovercraft Safety Requirements (BHSR) and the IMO High Speed Craft Code. The General Exemption is annexed to this MGN.

Maritime & Coastguard Agency issues MLC Guidance

The UK Maritime and Coastguard Agency (MCA) has issued a Marine Guidance Note providing stakeholders with guidance on the five titles of the Maritime Labour Convention (MLC) 2006 and the regulations applying to UK ships.

The purpose of this Marine Guidance Notice is to explain the UK’s understanding of key terms used in the Maritime Labour Convention, 2006 (MLC).The UK intends to implement the MLC fully and without departing from the intention of those who drafted the Convention.
